Reasons

The landlord attended the hearing which was held by teleconference. The tenant did not answer either of the calls made to him at the scheduled time on the number provided to the Tribunal.
Because I am satisfied the tenant has been served notice of the hearing in accordance with the Residential Tenancies Act, 1986 and the tenant has not requested an adjournment, the hearing was conducted in the tenant’s absence.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 25 August 2024. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy is $1,864.28.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
At the end of the tenancy the landlord found the premises to be very unclean and littered with rubbish and belongings. The landlord provided an invoice in support of her claim. I have reduced the amount awarded a little to account for the fact that tenants are required to leave a premises reasonably clean and tidy and it is my expectation that landlords then conduct an end of tenancy clean before re-letting.
The tenant did not return the keys. The landlord provided an invoice for having new locks fitted to the property.
During the tenancy, the tenant damaged the fridge beyond repair. The fridge was brand-new at the beginning of the tenancy.
During the tenancy the tenant repeatedly dumped bags of rubbish on the kerb. The rubbish was not in the correct rubbish bags, and they were not dumped on the correct rubbish days.
The landlord eventually took responsibility for collecting the rubbish, and disposing of it correctly. The landlord has produced an invoice for the costs involved in doing this.
The amounts ordered are proved.
Because Comprende Limited has substantially succeeded with the claim I have reimbursed the filing fee.
