Reasons

This application was scheduled to be heard by video conference. Mr Howarth did not link to the Teams link at the scheduled hearing time and the number I rang for him appeared to be incorrect because it was answered by a person who did not know Mr Howarth. However I accept the landlord’s evidence that this number was Mr Howarth’s number during the tenancy. Mr Howarth has been served with a notice of hearing and it is his responsibility to advise the Tribunal of his mobile number. He did not do so and so the hearing proceeded in his absence.
The landlord has applied for rent arrears, compensation, payment of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

Mr Howarth was served with a 90 day notice of termination because the house he was renting was being sold. The expiry date of that termination notice was 15 September 2024. I accept the rent record which proves that as at 15 September 2024 Mr Howarth owed $1,277.15 in rent.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The photographs show that the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. In particular there was a significant amount of rubbish left behind in the garage and outside, the lawns were long and the garden had not been weeded. I also note the photographs showing food spills and stains on the carpet and areas of the house which had not been cleaned.
The amounts ordered are proved by invoices. Filing fee reimbursement
I am also ordering Mr Howarth to reimburse the application filing fee to the landlord because the landlord was wholly successful in the claim against him. C ter Haar 16 January 2025
