Both parties attended the hearing.

The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

One of the tenants, Ms Kaur, objected to the hearing proceeding. She said that it should be an in-person hearing so that she had an opportunity to present documents. Ms Kaur has had an opportunity to provide the Tribunal with documents before this hearing, by sending them to the Remote Registry as set out in the instructions on the Notice of Hearing.

She could also have attended by the video link provided and shown her documents that way. She did not join the hearing by the link, but did answer her phone when the Tribunal called.

Ms Kaur said that she should have been granted an adjournment and was waiting to hear from the Tribunal in relation to an adjournment request. There is a record of Ms Kaur contacting the Tenancy Services Call Centre in January 2025 regarding the possibility of an in-person hearing and adjournment and being referred to the Tribunal (Ministry of Justice).

The Tribunal did not receive an adjournment request (supported by evidence) from Ms Kaur. The Tribunal file shows that both tenants were served with the application and supporting documents, and both received the reminder messages from the Tribunal system.

Ms Kaur also claimed that she has made a cross-application. There is no record of any outstanding application by Ms Kaur in respect of this tenancy. Historic applications have been determined and cannot be revisited in this hearing.

This type of application is suited to remote/video hearing and is the type of application regularly heard by video hearing.

I determined that it is was appropriate to proceed with the hearing and declined any adjournment request or transfer to an in-person hearing.

The tenancy ended on 11 September 2024. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy. The amounts ordered are proved.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The tenant did not return the keys.

The landlord submitted photographs, receipts and invoices in support of its claims. It also provided copies of emails with the tenant. The tenants disputed the claims and questioned the landlord’s honesty. However, I find that the landlord has provided sufficient evidence to discharge the onus of proof. The amounts ordered are proved.

As the landlord was the successful party, I award reimbursement of the Tribunal application fee and grant the landlord’s request for suppression of its details.
