Annlisa Tuiloma must pay [The landlord/s] $1,586.64 immediately, calculated as shown in table below.

Reasons

The landlord attended the hearing on the 20 February 2024. The tenant did not attend.
The tenant was in a fixed term tenancy which began on the 1 August 2024. On the 30 October the tenant stopped paying rent and told the landlord that she was moving to Australia. The tenant stopped communication with the landlord soon after. The landlord went to the property in November and found that the tenant had moved out. The landlord took possession of the property and rented it to new tenants on the 9 December 2024.
The landlord has applied for rent arrears until the 8 December 2024, and compensation for cleaning, rubbish removal, lawns and garden work, and letting fees and charges associated with re-tenanting the property, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

As the tenant signed a fixed term tenancy agreement the tenant is liable for rent up until the new tenancy began. The landlord provided rent records which prove the amount owing.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
Whilst the tenant moved all her items out of the house and had made some attempt to clean the property, there were items that needed cleaning, such as vacuuming the floors and washing the hard surfaces, bathroom and kitchen and the oven. The landlord had cleaners complete the work and the tenant is liable for cost of the cleaners. The amount charged is reasonable for the work completed.
The tenant did not remove all rubbish from outside the property. The landlord says that there were mattresses left by the tenant which needed to be disposed. The landlord provided an invoice for rubbish removal.
The tenant did not leave the lawns mowed and tidy.
The amounts ordered are proved.
The landlord claimed the cost of cleaning the carpet. I have not awarded this cost as I am not satisfied that the carpets required cleaning. The exit inspection report notes that the staining that is present was pre-existing. This tenancy was for a short period. I am not satisfied that the tenant caused the staining to the carpet. Is the tenant responsible for the costs incurred by the landlord in re-tenanting the property?
When a tenant breaks a fixed term tenancy, they are usually liable for the both the rent until a new tenant is found and the costs of re-letting the property. The costs must be reasonable and have been incurred by the landlord.
The landlord sought $976.35 for costs associated with re- letting the property. I allowed the landlord further time after the hearing to submit invoices and evidence which proved that those costs were incurred. The landlord did not file any further documents after the hearing.
The landlord submits that it incurred a letting fee, the costs of advertisement for a new tenant and showing the property to new tenants.
No evidence was submitted that proved how much time was spent showing the property or the expenses involved, no evidence of the actual advertising costs or the ‘reletting’ costs.
The landlord has not proven its loss and therefore the landlord’s application for the costs of breaking the fixed term tenancy are dismissed. Filing fee and name suppression.
As the landlord has been mostly successful in its application then it is awarded the filling fee and granted name suppression.
