The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 14 January 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.
The landlord had applied for water rates but that claim was withdrawn at the hearing because nothing was owed.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
The tenant thought that the invoice for cleaning was excessive. I accept that the tenant should not be charged for cleaning the rangehood because the ingoing photograph showed that it was not reasonably clean at the beginning of the tenancy. I have reduced the invoice to take account of this.
The cleaning invoice includes cleaning of a large black stain on the carpet.
Given that the house was not reasonably clean at the end of the tenancy the invoice is awarded (less an amount for the rangehood).
The landlord claimed for painting a wall where a house plant had climbed up the wall and the marks could not be cleaned off. That amount is awarded.
The landlord claimed for further cleaning of the carpet due to a urine smell. The tenant has produced an email where she complained of smells from the carpet on the day before the tenancy commenced. The landlord referred to urine stains on the carpet, however given the complaint by the tenant and that the age of the carpet was not known, I am not convinced that this tenant caused the urine stain on the carpet. That part of the landlord’s claim is not allowed.
Because The Rent Shop Limited - As Agent For Advait Kanna Family Trust has substantially succeeded with the claim I have reimbursed the filing fee.
