Reasons

The tenancy commenced on 15 November 2016. The landlord engaged a Property Manager as an agent. On or about 04 March 2024, there was a change whereby the landlord took over day to day management of the tenancy. On 24 October 2023, the landlord served the tenant 90 days’ notice to end the tenancy on 25 January 2024. The tenant vacated the property on 07 February 2024.

On 18 December 2024, the landlord filed a claim with the Tribunal. As the application was filed more than two months after the end of the tenancy, the usual rules for service no longer applied. See section 91A of the Residential Tenancies Act 1986 (The “Act”). On the same date, the landlord confirmed the tenant’s up to date address for service and email address. These details were provided with the application.

On 03 March 2025, the matter was scheduled for hearing today 18 March 2025. Notices of hearing were sent to each party at the physical and email addresses provided.

The landlord appeared. There was no appearance by the tenant. The Tribunal was assisted by a Mandarin translator. I am satisfied that the tenant has received notice of the date, time, and place of hearing, and the matter has proceeded in their absence.

The landlord’s claims are that the tenant: i. Owes rent arrears to 07 February 2024 ($1,785.00), ii. Failed to leave the property reasonably clean and tidy ($541.63), iii. Failed to remove all rubbish ($395.00).

In brackets next to the claims is the compensation sought.

The onus of proving these claims rests with the landlord. The standard required is on the balance of probabilities. The landlord must establish more likely than not that the tenant has breached the terms of the agreement or provisions of the Act. Rent

The tenancy ended on 25 January 2024. However, the tenant did not vacate until 07 February 2024. The landlord provided has provided up to date rent records. The claim is proven, and the amount claimed is awarded.

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) of the Act.

The Act does not require the premises to be provided or returned in a spotless or an immaculate condition. The standard is based on what an average bystander would consider reasonable, and not on the subjective opinions of the landlord and tenant. There is no scientific way to determine what is reasonably clean and tidy. Determining whether the tenant has failed to leave the property reasonably clean and tidy, and remove all rubbish, will involve an objective assessment. The Tribunal must evaluate the evidence available, and in particular inspection reports and photographs.

The landlord has produced a pre tenancy checklist, which describes the property as: “House and grounds in clean and tidy condition”. The landlord has also produced photographs taken at the end of the tenancy, which clearly show that the tenant has failed to leave the property reasonably clean and to remove all rubbish. The amounts claimed are reasonable in the circumstances and are awarded in full. Costs
