The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy was ended on ended on 19 December 2024 by an Order made by the Tribunal on that date (application 5072649).

The tenant did not vacate and return the keys and the landlord was not able to recover possession of the premises until 6 January 2025. The tenant is liable for rent until that date (see. s.60(1) RTA).

The landlord has provided rent records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986

Exit inspection photographs provided by the landlord show that the tenant did not leave the premises reasonably clean and tidy. A large quantity of goods and rubbish was left at the premises. The keys and access card were not returned.

The landlord arranged for its contractors to pack up all of the goods left at the premises by the tenant and take them to storage.

The landlord’s evidence, which I accept, is that: a. the landlord has made reasonable attempts to contact the tenant and arrange for her to collect the goods; b. there are no personal documents which need to be delivered to the police in terms of s.62A(5)(b) RTA; c. the landlord has properly assessed the goods as not having a value above the cost of storing, transporting and selling them.

The landlord may accordingly dispose of those goods as it sees fit. If any goods are sold, the sale proceeds must be applied against the sum owing under this Order

The landlord arranged for the contractors to clean the premises, replace the locks, obtain a replacement swipe card and patch a hole in one of the walls.

The photographs show a need for comprehensive cleaning of the premises. I have awarded compensation in an amount slightly less than the contractor’s charge as that cleaning work brought the premises to a condition ready for start of a new tenancy whereas the tenant’s obligation was to leave them reasonably clean and tidy.

The photographs, including entry photographs, also prove the damage caused to the premises during the tenancy, repaired by the contractors.

An invoice has been provided showing the contractor’s charges made for that work which I accept are reasonable and represented a loss to the landlord which the tenant should compensate the landlord for.

Included in that invoice is a charge for $500.00 + GST for storing the tenant’s goods. I have reservations about whether that is a reasonable charge to require the tenant to pay. The effect of this Order is that the landlord will now need to arrange for disposal of the tenant’s goods, which will incur further costs for vehicle hire, labour and dump fees. I am satisfied that compensation of $500.00 + GST is reasonable for the costs of both the storage and disposal the goods left by the tenant.

Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
