Reasons

The landlord attended the hearing which was held by teleconference. The Tribunal was unable to contact the tenants on the contact numbers provided in the application. I was satisfied that adequate service of the hearing notice had been completed and therefore deemed it reasonable to proceed with the hearing in the tenants’ absence.
The landlord has applied for rent arrears, compensation (for cleaning, rubbish removal and gib board repairs on multiple walls), refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended by eviction on 14 January 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
In this case, the landlord claims $948.75 for cleaning and $1,354.90 for rubbish removal and gib board repairs to multiple internal walls. In support of the claims, the landlord has provided the initial entry property condition report, photographs of the condition of the property at the end of the tenancy and invoices for work completed.
On the balance of probabilities, I am satisfied that the landlord has proven the following: • The premises were not left in a reasonably clean and tidy, and substantial rubbish was left behind by the tenants. • There was damage to gib board in multiple areas of the property caused during the tenancy. The nature and extent of the damage exceeds fair wear and tear. As the tenants have not disproved liability, they remain responsible for the damage caused.
The amounts ordered are proved.
I do not consider any adjustment for depreciation in relation to repair costs to be appropriate in this instance. Filing fee and suppression order
As the landlord has wholly succeeded with the claim, I must order the tenants to reimburse the filing fee and grant suppression of the landlord’s name and identifying details.
