The tenancy ended after the tenant abandoned the premises and the fixed term tenancy in October/November 2024.
The landlord provided rent records until the date the premises were relet on 20 December 2024. This proves the amount owing at the end of the fixed term tenancy and represents the actual loss of rent suffered by the landlord on account of the tenant’s abandonment.
The landlord also had to incur power reconnection costs and costs to readvertise the premises after the tenant abandoned the fixed term tenancy.
The amounts ordered are proved.
The bond has since been disbursed to the landlord to cover some of the rent arrears.

A tenant commits an unlawful act if they abandon the premises when the rent is in arrear. Exemplary damages may be awarded up to a maximum of $1,500.00. See section 61(5) and Schedule 1A Residential Tenancies Act 1986.
The tenant abandoned the fixed term tenancy without notifying the landlord. I find they have committed an unlawful act.
Where a party has committed an unlawful act intentionally, the Tribunal may award exemplary damages where it is satisfied it would be just to do so, having regard to the party’s intent, the effect of the unlawful act, the interests of the other party, and the public interest. See section 109(3) Residential Tenancies Act 1986.
Having regard to those factors, and the tenant not having appeared at the hearing to proffer any cogent reason for the abandonment of the premises and the fixed term tenancy, I award exemplary damages of $850.00 in favour of the landlord.
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
I also order the suppression of the landlord’s names and identifying details as requested.
