The landlord shall dispose of the other goods left at the premises by the tenant by: a. selling all goods with a saleable value by public auction or by private contract at a reasonable market price, and b. disposing of all goods with no saleable value as the landlord sees fit.

The amount owing to the applicant out of the proceeds of any sale is $3,789.15.

Reasons

Both parties attended the hearing which was held by teleconference.

The landlord has applied for termination of the tenancy for abandonment, rent arrears, compensation, a disposal order, refund of the bond and reimbursement of the filing fee.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 31 January 2025 the landlord became aware that the tenant had abandoned the premises. At today’s hearing the tenant confirmed that they left the property without giving notice and whilst being in rent arrears.

Because the premises were abandoned and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy is $6,000.00. The amount ordered includes rent in lieu of notice.

The landlord provided water rates invoices which prove the amount owing at the end of the tenancy is $38.90.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord provided photographs which show the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The photographs show the lawns and gardens to be moderately overgrown.

The landlord provided receipts for garden and lawn work, and for cleaning and rubbish removal.

The amounts ordered are proved.

A child’s quad-bike and a child’s motorbike were also left in the garage.

The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.

The landlord has been in contact with the tenant, but the tenant has not collected their belongings.

The value of the goods is below the cost of storing, transporting and selling them. If the tenant does not collect their belongings by 5.00 pm on Sunday 2 March 2025, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.

Because Tauranga Residential Rentals Limited T/A: Quinovic Property Management As Agent For Carolyn Reid has substantially succeeded with the claim I have reimbursed the filing fee.
