Hunter James Durrant, Roopesh Jaun and Yasmin Alexis McIntosh must pay Wongeoon Vast Limited $8,444.45 immediately, calculated as shown in table below:

Reasons

Both parties attended the hearing. Mr Durrant and Ms McIntosh represented the tenants. Mr Wongeoon represented the landlord.
The landlord named 2 other tenants in the application. Both attended and successfully defended the application. Mr Wongeoon accepted that one of the tenants had been released from the tenancy before the rent arrears accrued. I gave an oral decision that the other tenant had been released also.
In both cases, the landlord’s clear communications releasing those tenants from the tenancy amounted to a variation of the tenancy agreement, not disputed by the remaining tenants.
Unlike the 2 tenants who provided proof that they had been released from the tenancy before it ended, and before the rent arrears accrued, Mr Durrant could not prove that he was released. I explained that in the absence of clear proof of a variation of the tenancy agreement releasing him from the fixed term tenancy, he remained a named tenant and remained jointly and severally liable for costs awarded against the tenants. How much is owed for rent?

The tenancy ended on 29 December 2024. The landlord provided rent records which prove the amount of rent owing at the end of the tenancy.

Did the tenants comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
The tenants did not leave the premises and the lawns and gardens reasonably clean and tidy and did not remove all rubbish.
Two garage door remote controls listed in the chattels list in the tenancy agreement (which Mr Durrant initialled) were missing at the end of the tenancy.
The amounts ordered are proved by invoices produced in evidence. The tenants did not oppose the costs sought by the landlord for cleaning, gardening, and rubbish removal.
As the application is successful, the tenants must pay the landlord’s Tribunal filing fee.

What now?

The Tenancy Tribunal adjudicates disputes between landlords and tenants, not between tenants. If the tenants named in this order consider that the responsibility for the rent arrears and the costs awarded to the landlord should be split other than on a joint and several basis, they can apply to the Disputes Tribunal for an order as to individual liability.
