Reasons

Both parties attended the hearing.

Following a mediation held 19 December 2024, a mediator’s order (5085519) recorded that as at 19 January 2025 the total debt owed by the tenant was $7,016.72 made up of: a. $6,857.14 in rent arrears; b. $132.58 for water rates; and c. $27.00 for the application fee for that application.

The mediator’s order recorded the agreed conditions on which the tenant would pay the debt owed. If the tenant failed to do so, the tenancy would end immediately.

The parties confirmed the tenant did not satisfy the conditions of the mediator’s order and on 3 February 2024 the tenant was evicted and the tenancy came to an end.

The landlord has now applied for additional rent arrears and water rates, compensation for cleaning and rubbish, compensation for the costs of eviction and replacing the front door key, refund of the bond, and reimbursement of the filing fee.

How much is owed for rent and water rates?

The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.

The tenant accepts the amounts as sought by the landlord are owed.

By consent, I make an order for payment of the additional rent arrears and water rates.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. Cleaning

The landlord says the tenant did not leave the premises reasonably clean and tidy. The landlord filed (on the day of the hearing) a copy of the exit inspection conducted on 5 February 2025. Photos show the interior of the premises was cleared of all the tenant’s furniture and belongings but that carpets were not vacuumed and surfaces were not wiped down.

The landlord initially sought $922 in payment for cleaning, including carpet cleaning, and window cleaning. However at the hearing, it was amended to $874 as the landlord no longer sought compensation for cleaning the exterior and interior windows.

The landlord filed an invoice which was itemised into three amounts: cleaning and carpet cleaning, blinds cleaning, and, windows cleaning.

The landlord referred me to the exit inspection photos which showed a blue/purple stain on the carpet in one of the bedrooms. No photos were produced to show the condition of the carpet, or other items, at the start of the tenancy.

The tenant accepts she did not have time to clean the premises before leaving, and that she should compensate the landlord for that, but disputes whether the charge of $922, or the amended $874, is reasonable. The tenant accepted she created the stain on the carpet in the bedroom as a result of painting inside.

A tenant is not required to leave a property in an immaculate standard of cleanliness. The standard is what an average, reasonable bystander would consider “reasonably clean” and “reasonably tidy”.

I find the landlord has proved (and the tenant accepts) that the premises was not left reasonably clean. I do not, however, consider the tenant is liable for the full cost of a professional clean, which would no doubt take the level of cleanliness above “reasonably clean.”

The invoice provided does not itemise the cost of cleaning as distinct from the cost of carpet cleaning. While a tenant is not, as a rule, required to have carpets professionally cleaned, in this case the tenant accepts she did cause the stain visible in bedroom 1, and it is therefore appropriate that any award for compensation for cleaning includes a contribution towards the cost of cleaning the carpet.

I consider an award of $200 for cleaning and carpet cleaning is a reasonable amount considering the standard required. Rubbish removal

The landlord says the tenant did not remove all rubbish from the premises at the end of the tenancy. The landlord produced photos taken on 5 February 2025 which show piles of rubbish and unwanted items were left around the exterior of the premises. The landlord filed an invoice for the cost of rubbish removal for $500.

The tenant accepts she left rubbish behind and accepts the amount sought by the landlord is reasonable.

By consent, I make an order accordingly. Eviction costs

The landlord says the landlord was required to seek an eviction warrant in order to bring the tenancy to an end. The landlord has filed a copy of the invoice from the Ministry of Justice showing the cost of the warrant was $258.00.

The tenant confirmed she left the premises on 3 February 2025 when the bailiff attended.

The landlord has proved the cost sought was incurred in the course of terminating the tenancy, and I make an order accordingly. Replacement keys

The landlord seeks compensation for the cost of installing a new front door key.

The landlord says the lock was replaced by the bailiff on 3 February 2025, in the course of the eviction. The landlord has filed an invoice for the amount sought, being $155.25.

The tenant says she was present when the bailiff and landlord attended the premises on 3 February 2025 and she handed the key to the front door to the landlord.

The landlord says he does not recall the tenant giving him the front door key, but says in any event, the front door lock had to be changed as it is standard in the case of an eviction.

I am satisfied the tenant gave the keys to the landlord on the day of the eviction. The tenant presented as being an honest witness, who accepted other aspects of the landlord’s claim, but denied this claim. I find her recollection of handing the keys to the landlord on 3 February 2025 is reliable.

Having found the tenant returned the keys at the end of the tenancy, I find she did not breach her obligations under s 40(1)(e)(iv). The landlord’s decision to have the front door key and lock replaced was not as a result of the tenant’s failure to return the keys, therefore, it is a cost that must be born by the landlord.

I dismiss the landlord’s claim for the cost of replacing the front door lock. Should the tenant reimburse the landlord’s application fee?

As the landlord has succeeded with the claim, the tenant must reimburse the filing fee.
