The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended by consent on 13 May 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy was $5,400.00. Ms Kaal does not dispute this. Expenses
Ms Kaal also did not dispute the costs for cleaning and rubbish removal.
These amounts are ordered by consent.
The landlord is claiming 13 hours labour for tidying up at the end of the tenancy, including making minor repairs and taking rubbish to the dump. The landlord would like to be paid $40.00 per hour for his time.
Ms Kaal does not dispute the amount of time claimed, but considers $40.00 per hour to be excessive for this sort of work. She considers $25.00 an hour to be reasonable hourly rate for this work.
I consider much of the work was unskilled work. The landlord stated it would have cost more than she is asking for, if a handy man had been involved. Against this, there would have been actual expense to the landlord, and the requirement to work with someone else’s timeframe. I consider there was convenience and security in the landlord undertaking this work himself, and I determine that in the circumstances $30.00 per hour is a reasonable rate of compensation.
The amount is ordered. Failure to quit premises
Under section 40(1)(e) of the Residential Tenancies Act, 1986, a tenant must, on the termination of the tenancy, quit the premises. To fail to quit the premises is an unlawful act and exemplary damages may be awarded.
The landlord claims the tenant should pay exemplary damages for failing to quit the premises earlier.
This claim relates to the fact that the tenant intimated several weeks before the end of the tenancy that she intended to give notice on the tenancy. However she did not give formal notice. Instead, the date of 13 May 2025 was agreed as the end date of the tenancy, notwithstanding that the tenant had moved out some time earlier, leaving behind personal belongings and failing to return the keys at that time.
On the basis of this agreed information, the tenancy was not terminated, and section 40(1)(e) has no application. I also note that the landlord has claimed, and the tenant does not dispute being liable for, rent up until 13 May 2025, as well as for compensating the landlord fully for removing her left behind items and tidying up the property. The landlord will therefore be fully compensated for all expenses incurred during this tenancy. Even if exemplary damages were available to the landlord, I would not consider it just to award them in the circumstances.
Because My Property Manager Limited As Agent For Tim Dennison has substantially succeeded with the claim I have reimbursed the filing fee.
