Reasons
Introduction
- By order of the Tribunal, the tenancy of [The tenant/s] tenant/s] (the Tenant) at 17 Kiato Lane, Flat Bush, Auckland 2019 (the Premises) was terminated on 25 June 2025.
- Barfoot & Thompson Limited As Agents For Sokunbopha Ny (the Landlord) says that following the end of the tenancy, the Tenant owes rent arrears, water rates and compensation for cleaning.
- The Tenant did not attend the video hearing on 10 September 2025 and a call to his last known number went to voicemail. The Tenant has not filed a response to the Landlord’s claims.
- The issues I have to determine are: a. Does the Tenant owe the Landlord rent arrears? b. Does the Tenant owe the Landlord unpaid water rates? c. Did the Tenant fail to leave the Premises reasonably clean at the end of tenancy? d. Should the Tenant reimburse the Landlord for the cost of the Tribunal application fee?
Does the Tenant owe rent arrears?
- The tenancy ended on 25 June 2025. The landlord provided rent records which prove the Tenant owed rent of $4,274.29 as at that date.
- The Landlord confirmed the bond of $2,720 is held by the Bond Centre. I order the bond be paid by the Landlord, and the Tenant is to pay the Landlord the remainder of the rent arrears.
Does the Tenant owe the Landlord unpaid water rates?
- The Landlord provided two water invoices dated 3 April 2025 and 9 May 2025. The first invoice proves the Tenant consumed $19.80 worth of water between 6 March 2025 and 2 April 2025, and the second proves the Tenant consumed $5.49 worth of water between 3 April 2025 and 2 May 2025. For each of those monthly invoices the “fixed charge” is the Landlord’s responsibility.
- I am satisfied the Tenant owes the Landlord $25.29 for water consumed during the tenancy and make the order accordingly.
Did the Tenant fail to leave the Premises reasonably clean at the end of tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy. 1 The Landlord produced photographs taken on 25 or 26 June 2025 which show the Tenant’s belongings had been removed from the Premises but that the Premises were not left not reasonably clean. Areas such as the bathroom and kitchen did not appear to have been cleaned.
- The Landlord also produced an invoice for $448.50 dated 9 July 2025 as evidence of the cost to bring the Premises up to the required standard. The Landlord says it took two people three hours to clean the two-bedroom, two- storey premises.
- I am satisfied the Landlord has proved the Tenant did not leave the Premises reasonably clean and that the Landlord incurred the cost as sought. I make the order accordingly. Should the Tenant reimburse the Landlord for the cost of the Tribunal application fee?
- As the Landlord has wholly succeeded with the claim the Tenant must reimburse the filing fee.
