At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.

The tenant must not carelessly or intentionally damage the premises.

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent).

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.

The Tribunal must consider betterment and depreciation where appropriate. The landlord should be returned to the position they would have been in had the tenant not breached their obligations and should not be better or worse off. In calculating depreciation, the Tribunal considers the age and condition of the items at the start of the tenancy and their likely useful lifespan. Claims – Discussion and Decision

The premises were not left reasonably clean and tidy, and rubbish was not removed. The premises were left in a very bad state.

There was damage to the premises during the tenancy including to walls, doors, windows and the garage door. The garage door could not be repaired, and the landlord has replaced it.

The damage exceeds fair wear and tear and the tenant has not disproved liability for the damage.

The damage to walls consisted of multiple holes from impacts. From the nature and extent of the damage I find that it was intentional.

It is unclear what caused the impact damage to the garage door. I find that it was likely caused by a car hitting the door and that it was careless damage.

The landlord chose the most economical way to remediate the damage. He employed people to clean, remove rubbish and repair and paint at a modest hourly rate and he paid for materials and other related costs himself. I am satisfied the amounts claimed are entirely reasonable and properly due from the tenant.

There was no list of claims. The landlord produced various invoices and receipts. He confirmed that he paid for two skips for rubbish removal, and for various materials including doors and paint.

There were invoices for water blasting, tools and a basin tap. There is no basis for awarding those costs against the tenant and so those claims are dismissed.

The landlord provided his insurance policy for the premises which show that there is a $750 excess.

The damage to the garage door should be covered by the policy although the landlord has not thought to make a claim. I have therefore awarded $750 for the garage door damage. Filing Fee

The landlord has been largely successful and so I have awarded him the filing fee. Suppression

For the same reason I have granted the landlord’s request for name suppression.
