The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenants, although one had been in recent contact with the Registry. Calls to all three tenants were attempted but unsuccessful. I was satisfied adequate service had completed and I continued with the hearing after the call went unanswered.

The landlord has applied for rent arrears, water rates, compensation, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy was terminated by prior Tribunal order [TT5221958] on 28 May 2025 but it extended to Monday 16 June 2025 when a bailiff eviction occurred. The monetary orders from that order are under enforcement.

The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy. Rent

Given the prior order made orders for rent arrears to 28 May 2025, and released the bond, the final rent accounting produced a credit to the tenants. This was due to agency payments continuing for a period after the eviction. A rent credit of $457.70 is applied against the debt in this order. Water

The landlord provided a water summary that established the water rates owing (consumption) of $239.98. Given the short duration of the tenancy there were no prior invoices.

Did the tenants comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord claimed the tenants did not leave the premises reasonably clean and tidy, and did not remove all rubbish. It said the lawns were overgrown and required cutting. Invoices for $713.00 (cleaning) and $605.00 (rubbish removal and lawn mowing were provided. Photos evidenced the need for the work carried and cost incurred. Both invoices are evidenced and are awarded in full.

The tenants did not return the keys. Given that, and bailiff enforcement, the landlord was entitled to replace the locks and seek compensation. An invoice for $116.00 was produced and that is accepted in full.

The landlord also arranged for a full pest control of the house ($425.00). Cockroaches were found mainly in the hot water cylinder cupboard. The landlord reported seeing some in the kitchen but it was accepted the main location was the cupboard. The house was relocated to the current location prior to this tenancy. It sits on some elevation with an exposed and large sub- floor. The cylinder is piped through the floor.

I accept the presence of the cockroaches as shown but given their location and possible entry through the pipe gaps I do not find this cost to be proven as a tenant liability and the claim is dismissed.

Did the tenants damage two blinds?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

During the tenancy, two blinds were removed from one bedroom. No notice or reason regarding this was ever made to the landlord but at exit one blind was found missing and the other stored. The blind mechanisms were broken. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.

The invoiced amount of $184.25 for two replacement blinds is awarded. The blinds were recently installed so no depreciation should be applied. Filing fee

Because Just Listed Limited As Agent For 16R - Samuel Fulcher has substantially succeeded with the claim I have reimbursed the filing fee.
