I am satisfied that proper service of the hearing notice had been completed and considered it reasonable to proceed with the hearing in the tenant’s absence.
The landlord has applied for rent arrears and compensation following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of a tenancy, a tenant has a legal obligation to leave the premises in a reasonably clean and tidy condition, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. This duty is set out in section 40(1)(e)(ii)–(v) of the Residential Tenancies Act 1986.
In this case, the landlord seeks reimbursement for cleaning and rubbish removal costs incurred at the end of the tenancy. In support of the claim, the landlord produced both the ingoing and exit inspection reports, as well as photographs documenting the condition of the premises upon vacating.
Having considered the evidence, I am satisfied on the balance of probabilities that the tenant did not comply with their statutory obligation to leave the premises reasonably clean and tidy and to remove all rubbish. The photographs provided by the landlord show clear discrepancies between the condition of the premises at the beginning and at the end of the tenancy. These include visible debris, unclean surfaces, and discarded items that were not removed.
The landlord waives the filing fee.
