Reasons

The landlord attended the hearing by video. Attempts were made to join the tenants to the hearing by telephone, but all calls went unanswered. I am satisfied that the tenants have been served with the landlord’s application in accordance with the service provisions of the Residential Tenancies Act 1986 (RTA) and so the hearing proceeded in the tenant’s absence.
Since applying to the Tribunal, the tenancy has ended. The tenants gave notice to vacate, and the last day of the tenancy was 17 July 2025.
The landlord has applied for rent arrears and water rates and has provided rent records and water rates invoices which prove the amount owing.
The landlord had claimed for replacement of a commercial chest freezer which was in the garage of the premises. I note that the freezer was not on the chattels list in the tenancy agreement.
The landlord referred to the entry inspection report showing a photograph of the chest freezer which was not there at the end of the tenancy.
The landlord produced email correspondence with the tenants which includes reference to the chest freezer. The tenants deny taking the chest freezer and instead say that a third person came on to the premises and took it.
The landlord said that the chest freezer is 7 or 8 years old but did not have any evidence to confirm that. She also said that from her investigation the value of a second-hand chest freezer of its kind would be $500.00.
There is uncertainty in relation to what happened to the chest freezer and the value of it. According to the email from the tenant the landlord was storing the chest freezer at the premises until they got it sorted.
On the evidence it is not clear that the tenants are liable for the chest freezer and even if they were there is no evidence of its likely value. The landlord’s claim in relation to the chest freezer is dismissed.
Because Property Brokers Limited has substantially succeeded with the claim I have reimbursed the filing fee.
