Reasons

Both parties attended the hearing which was held by teleconference on 28 October 2025.
This matter relates to a tenancy that commenced on 9 September 2016 and ended on 29 April 2025. The landlord has applied for rent arrears and compensation following the end of the tenancy. The tenant confirmed at the hearing that she did not dispute the claims and agreed to all amounts sought.
In relation to rent arrears, the landlord provided a rent summary showing an outstanding balance of $78.57 as at the tenancy end date of 29 April 2025. The Tribunal is satisfied that the landlord’s records are accurate and show the amount owed. As the tenant agreed to this amount by consent, the claim for rent arrears is proven and allowed.
Section 40(1)(e)(ii) of the Residential Tenancies Act 1986 (RTA) requires tenants, on termination of the tenancy, to leave the premises reasonably clean and tidy and to remove all rubbish. The landlord provided evidence including the ingoing and exit inspection reports, detailed accounts, and photographs in support of its claims for cleaning and rubbish removal. The evidence establishes that the premises were not left in a reasonably clean and tidy state, and that rubbish remained both inside and outside the premises at the end of the tenancy. Accordingly, the Tribunal is satisfied that the tenant breached her obligations under section 40(1)(e) RTA, and the landlord is entitled to compensation.
The landlord also claims compensation for damage to the premises, specifically wall damage consisting of multiple holes that required repair. Under sections 40(2)(a), 41, and 49B of the RTA, a landlord must prove that the damage occurred during the tenancy and was more than fair wear and tear. Once this is established, the burden shifts to the tenant to prove that the damage was not carelessly or intentionally caused. The Tribunal is satisfied on the evidence that the damage occurred during the tenancy and was more than fair wear and tear. The tenant did not offer any explanation or evidence to rebut the presumption of liability. Accordingly, the claim for wall repairs is also proven and allowed.
