This order incorporates the Tribunal order made on 4 June 2025 under application 5269440.

Reasons

The landlord attended the hearing represented by Ms Robinson.
The tenant did not attend the video hearing and not answer the calls made to her phone during the hearing. She had been notified of the hearing by email and text and had the hearing link, however did not attend. Accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in her absence.
The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy which ended by Tribunal Order on 4 June 2025. Also by that order the Tribunal made an order for rent arrears to 4 June and water rates to 31 March. The previous order is incorporated into this order for enforcement purposes.

Did the tenant comply with their obligations at the end of the tenancy?

The landlord has established in evidence that the tenant did not pay the water rates for the last few weeks of the tenancy between 1 April and 4 June. Accordingly, this amount is ordered as sought.
The landlord also claims reimbursement of the cost they were put to in cleaning the property and removing rubbish at the end of the tenancy.
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) RTA.
As applicants the landlord has the evidential burden of proving their claims to the required standard of the balance of probabilities. By photographic and oral evidence I find that the landlord has discharged their burden with respect to these claims.
As such I find that the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The amounts ordered are proven in evidence and considered reasonable in the circumstances.

Is the tenant responsible for the damage to the premises?

The landlord claims compensation for having to repair a large hole in the lounge wall. The tenants had placed some jib in the space however the repair was not complete and was roughly finished.
To be successful in such a claim, a landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
I am satisfied on the evidence that the damage is more than fair wear and tear, was caused during the tenancy and was most likely intentional damage. As such, the tenant is liable for the repairs. The amount sought is reasonable in light of the work required.
Because Mid North Real Estate Limited As Agent For John Hawke Cash has wholly succeeded with the claim I must reimburse the filing fee.
