How much is owed for rent and water rates arrears?
- The tenancy ended on 14 September 2025. The tenancy was fixed from 21 March 2025 to 6 February 2026. New Tenants moved into the property on 15 September 2025.The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
- The tenant did not leave the premises reasonably clean and tidy. Photographs were provided of the property which appeared as if it had been abandoned. There was rubbish left in the kitchen, on the table and on the floor. Photographs of the toilet showed it was filthy. An invoice was provided to substantiate the costs.
- The amounts ordered are proved. Break lease fee
- The Landlord claimed two weeks rent $1081.00 because the Tenant ended the tenancy early. They submitted this was in the Tenancy agreement at clause
- 4 which stated: ”If the Tenant wishes to vacate the fixed-term tenancy early, the Tenant may submit a request in writing seeking the Landlord's consent. The Tenant may also apply to the Tribunal to release from the tenancy agreement per S.66 of the residential tenancy Act 1986. The Landlord reserves the right to grant or decline the request for early release from the Tenant. The Tenant is liable for the rent and other matters contained in the agreement until they need to be formally released in terms of the agreement. If the Lease needs to transfer to a different name(s), a tenancy transferring fee of two (2) weeks' rent plus GST will apply”
- Section 44A RTA provides: (1) a landlord who consents to an assignment under section 43B, to a subletting or parting with possession under section 44, or to termination of the tenancy in accordance with section 50(1)(d) is entitled to recover from the outgoing tenant any expenses reasonably incurred by the landlord in respect of the assignment, subletting, parting with possession, or termination. (2) A landlord who seeks to recover expenses from a tenant in accordance with subsection (1) must first provide an itemised account of the expenses to the tenant.
- In considering the evidence, the Landlord sought to recover fees as a result of the early termination however did not provide any specific evidence as to the reasonable costs incurred in finding new tenants such as the advertising fees, viewings, inspections.
- For this reason, the claim is dismissed.
- As Global Property Management Limited As Agent For Nick Guan has substantially succeeded with the claim the Tenant shall reimburse the filing fee.
