This tenancy began as a fixed term tenancy in 2022. It became periodic after the fixed term expired.

On 18 August 2025 neighbours of the premises informed that landlord that the tenant had vacated them.

The landlord inspected the premises and found no sign of occupation. There was rubbish throughout the premises, they were unclean and there was damage to them. The landlord tried to contact the tenant without any success. No rent had been paid since the beginning of June.

The landlord made this application but did not apply for termination for abandonment. He is an inexperienced landlord, and he was not aware that he should do so.

The landlord has removed the rubbish left at the premises to the garage, but rubbish removal and other remedial work remain to be done.

The landlord produced a list of estimated costs which he said his brother complied after speaking with a contractor. There are no estimates or quotations.

The landlord was not well prepared for the hearing and so I have approached the claims on the basis that the need for the remedial work claimed for has been proved by the photographs provided of the premises and it is possible for me to estimate the cost of the work. My estimates are at the lower end of the range because the landlord has not provided good evidence of the actual costs he will incur. Termination and Possession

The landlord should have applied for termination for abandonment. But it is obvious that the tenant has abandoned the premises, and she has ignored the landlord’s attempts to contact her. It is obvious that she does not intend to be bound by the tenancy agreement and in those circumstances, there has been a surrender or repudiation of the tenancy that the landlord has accepted. I have therefore declared that the landlord is now in lawful possession of the premises. Rent

The landlord provided a rent statement to prove the amount of rent owing at the end of the tenancy which I have awarded. The Tenant’s Other Obligations

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.

The landlord must not carelessly or intentionally damage the premises

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent).

Where the damage is careless and is not covered by the landlord's insurance, the tenant's liability is limited to four weeks' rent (or market rent).
