At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The landlord provided some photographs in support of his claims. He understood that he had uploaded more, but there was no record of that on the Tribunal file. I gave him the opportunity to adjourn and provide more evidence. He declined.

The photographs and receipts provided establish claims for cleaning and rubbish removal. Including the landlord’s own time in removing rubbish. The tenant acknowledged that the property was not left clean and tidy. The amounts ordered are proved.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

The landlord claimed that the oven, hob, rangehood and curtains were damaged during the tenancy and had to be replaced. The claim for curtains was withdrawn at the hearing for lack of evidence.

The landlord did not provide sufficient evidence to prove the kitchen appliance claims either. However, the tenant accepted that the hob was cracked. I award $700 for that.

As the landlord was partially successful, I have awarded reimbursement of the Tribunal application fee.
