[The tenant/s] is the sole named tenant in the tenancy agreement. [The tenant/s] lived at the property with his wife Kaudi.
[The tenant/s] fell into water rates arrears after a large invoice in June 2024. The landlords investigated the large invoice, but there were no leaks at the property.
In April 2025, [The tenant/s] asked to change the tenancy into Kaudi’s name. A change of tenant form was partially completed but never signed by [The tenant/s].
On 18 August, Kaudi sent the landlords a text message stating that she wanted to leave the property and that she would be gone in one week at the latest.
Mrs Dillon replied stating “the process to end the tenancy is 21 days notice, so that takes you until 8 September”.
The landlords filed this application on 28 August 2025, seeking termination of the tenancy through the ‘expedited abandonment’ process, rent arrears, and water rates arrears.
On 9 September, the Tribunal made an order declining the application for termination. The application was scheduled for a hearing, which took place by phone today.
