This application was scheduled to be heard by teleconference. I rang the three numbers provided for the tenant. One was a wrong number and the other two numbers did not connect. I am satisfied that the tenant knew of the hearing because notice of it went to her email address. She did not advise the Tribunal of a phone number on which she could be reached and so the hearing proceeded in her absence.

The landlord has applied for rent arrears, compensation, payment of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy ended on 3 August 2025. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy - $1,071.43 for rent and $661.63 for water.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The photographs show that the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. Examples of the tenant not having left the premises reasonably clean is that drawers had not been wiped out, the oven was dirty, there was staining on the carpet throughout and the floors had not been mopped.

I have reduced the amount claimed for this from $862.50 to $750.00 because I note that the lounge carpet was already stained at the beginning of the tenancy and the tenant is not required to deep clean the premises

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent). See section 49B(3)(a) RTA.

There was a large brown stain in bedroom 4 which is beyond fair wear and tear. That wall required sanding and repainting.

There was also a broken window in the garage and the master bedroom.

The amounts ordered to remedy these issues are proved by invoices.

I note that the cost of repair was below the insurance excess of $1,000.00. Filing fee reimbursement

I am ordering the tenant to reimburse ethe filing fee to the landlord because the landlord was wholly successful with the claim against her. Suppression
