The tenancy ended on 25 June 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the kitchen reasonably clean. The tenant left a considerable amount of rubbish both in the interior and exterior of the property. It amounted to 16 cubic meters by volume. The lawns were significantly overgrown needing extra time to make several cuts.
The amounts ordered are proved.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Some doors and walls had minor damage and the tenant had painted one wall black. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
The landlord has claimed over $10,587.34 to completely repair and redecorate bedroom 3. The landlord provided four photos in support of the claim. The photos are not helpful to the landlord. They do not show damage. In addition, the tenancy was for about seven and a half years and the landlord could expect to redecorate the property shortly after the tenancy ended. Because there is insufficient evidence to prove the claim for a loss regarding bedroom 3, I have dismissed the claim.
The claim for an external patch repair was withdrawn.
The amounts ordered are proved.
