- Ms Stone and Mr Stone, directors of the applicant company, attended the hearing as agent for the owner. The tenant did not attend. I am satisfied that proper notice of the hearing was provided to the tenant.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent?
- The tenancy was a fixed term tenancy to 22 October 2025. The tenant vacated the tenancy on 18 August 2025. The landlord has claimed rent to that date. The landlord provided rent records which prove the amount of rent owing when the tenant vacated the tenancy.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit 1 .

Is the tenant responsible for the damage to the premises?
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission 2 .
- The following damage was caused during the tenancy. The kitchen vinyl was torn, and some carpet required repairs. The front gate was damaged. There were holes in walls throughout the premises. - The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
- The amounts ordered are proved by invoices and photos and by the evidence Ms Stone gave at the hearing.
- As the application is successful, I have awarded the landlord the filing fee. Result
- The bond will be paid to the landlord in full.
- After payment of the bond, the tenant must pay the landlord $3,238.14.
