Tenants must leave the premises reasonably clean and tidy and remove all rubbish at the end of the tenancy. 3
The landlord’s claim seeks: a. Pest control costs (fleas and cockroaches) $598.00. b. Skip bin hire $570.00. c. Disposal of fridge $150.00. d. Cleaning $305.00. e. Carpet cleaning $600.00. f. Lawns and gardens tidy up $70.00.
Mr Whaley provided photographs showing the condition of the premises at the end of the tenancy.
Having regard to those photographs my findings are that: a. The claims for general cleaning and for rubbish removal are proven and are fair and reasonable. The tenant left a substantial amount of rubbish and abandoned belongings at the premises including large items such as mattresses and furniture. It was necessary to hire a skip bin to dispose of the rubbish. The abandoned fridge could not be put in the skip bin and it 1 Section 91A(1)(e) Residential Tenancies Act 1986 (“RTA”) 2 Section 92 RTA 3 Section 40(1)(e)(iii) RTA had to be transported to the tip separately. I have awarded four hours of labour at $40 per hour in addition to the skip bin hire and fridge dumping costs. b. The claim for carpet cleaning is not proven. The entry inspection report noted that the carpet was stained at the beginning of the tenancy. The entry photographs show that the carpet was aged and stained. There is not sufficiently clear evidence of new additional stains during this tenancy. c. The claim for tidy up of lawns and gardens is not proven. The end of tenancy photographs do not show the lawns and gardens. d. The claim for pest control costs is proven. Although it is difficult to evidence the presence of pests, the premises were not reasonably clean and tidy, and the invoice shows that the landlord incured this cost. Damage
Tenants are liable for damage beyond fair wear and tear that occurs during the tenancy.
The following parts of the landlord’s claim are proven: a. Reglazing three broken windows $456.76. b. Replace missing smoke alarms $150.00. c. Replace missing door handles $237.32. d. Damage to heat pump $100.00. e. Replacement of damaged doors $395.40.
The following parts of the claim are partially proven: a. Damage to walls. The photographs show that there was damage to the walls beyond fair wear and tear that occurred during this tenancy. The claim seeks $4,236.00 for repairs and painting. The entry photographs show that the paintwork was not new at the start of this tenancy in 2022. Depreciation must apply to the painting portion of this cost, but not to the repairs. The invoice does not detail the split between repairs and painting. I note that the damage to walls was quite extensive. On the limited information available to me I will award compensation of $3,000.00 for damage to the walls. b. Kitchen benchtop. The claim seeks $898.00 for replacement of the kitchen benchtop. The benchtop was newly installed in July 2024. At the end of the tenancy the benchtop had a small hole on the top. This is damage beyond fair wear and tear that occurred during the tenancy, but it is not obvious that the damage necessitated replacement of the benchtop. I do not know whether the option of repair was investigated. At the very least the hole could have been sealed to prevent water ingress. The benchtop would still function as a benchtop even with this damage. I will not award the replacement cost claimed, but I will award compensation to reflect the fact that the tenant caused damage beyond fair wear and tear. I will award $200.00.
The following parts of the claim are not proven: a. Replacement of curtains and blinds. The photographs do not evidence damaged or missing blinds. b. “Frame outside bed 7”. It is not clear what this claim relates to. c. Replacement of window handles. The damage is not proven. Rent and water credit
There was rent in credit at the end of the tenancy.
The tenant paid $30 per week towards water during the tenancy. The ledger shows that the tenant had a water credit of $505.41. The final water was $500.24, leaving a small amount of credit. Filing fee, bond
