- When the landlord attended to the premises after the tenancy had ended, the inorganic items were still there. The landlord’s contractor disposed of the items as rubbish and the landlord claimed $50.00 for this.
- The tenant did not tell the landlord about the arrangement for the items to be picked up by someone else. The landlord is justified in treating the items as rubbish and claiming for compensation for it. I order the tenant to pay the landlord $50.00 for rubbish removal.
- Because the landlord has wholly succeeded with the claim, the tenant must also reimburse the filing fee.
- The bond held at the Bond Centre will be paid to the landlord to offset the amount payable by the tenant.
- The tenant also raised claims against the landlord at the hearing. However, as they were not formally lodged with the Tenancy Tribunal, those claims could not be heard.
