The landlord states the tenant verbally requested more time, did not return the keys, and left belongings in the premises. The landlord accepts that the tenant had left the property by 14 November 2025.

In this case, having considered the circumstances, I find the tenancy ended on the date the Tribunal terminated the tenancy, being 14 November 2025. There is no written evidence of the tenant making a request to extend the tenancy beyond this date, or evidence that the landlord had agreed to an extension. Accordingly, the landlord is entitled to rent arrears up to 14 November 2025.

The landlord provided rent records to establish the amount owing at the end of the tenancy. The landlord’s rent summary shows the bond payment has been included when calculating the final amount owed in rent.

The landlord also provided water rates invoices to support the water charges claimed, as awarded above.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986 (the RTA).

The landlord claims cleaning and rubbish removal costs. The landlord has provided evidence, including an invoice and inspection reports, with photographs showing the condition of the premises at the end of the tenancy, and prior to the tenancy commencing. This evidence establishes that the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. Items of furniture, including a sofa and beds, were left behind, and had to be removed.

The tenant did not return the keys, so the landlord had to change the lock. The invoice for the locksmith’s charges has been provided and is awarded above.

The landlord had to replace the remote for the gate, since it was not returned. The invoice for this cost was provided.

The amounts ordered are proved. Liability of the guarantor

Under section 2 of the RTA a guarantor is defined as follows: guarantor, in relation to a tenancy, means a person who guarantees the performance of the tenant’s obligations, or who indemnifies the landlord against loss that he or she may incur in respect of the tenancy, or who assumes liability for the performance of the obligations of the tenant, and guarantee has a corresponding meaning.

On 15 March 2021 [The guarantor], the guarantor, provided a guarantee to the landlord, which undertook that the guarantor would be liable for any breach of the tenant's obligations. Specifically, the guarantor undertook to “indemnify the landlord for any liability or loss suffered by the landlord as a result of or arising from any breach.”

The Tribunal has ordered the tenant to pay $4,419.19 to the landlord for the tenant’s breaches, which are all matters covered by the guarantee.

I am therefore satisfied that the guarantor is liable under the guarantee to pay the landlord the sum ordered. See section 77(2)(ka) of the RTA. Filing fee and name suppression

As the landlord has been substantially successful, the tenant is to pay the landlord’s filing fee.

Section 95A(4) of the RTA provides that the Tribunal may, on its own initiative, having regard to the interests of the parties and to the public interest, order that the name or any identifying particulars of any party not be published. On my own initiative, and pursuant to s95A(4), I have suppressed the tenant’s name, in view of the tenant’s circumstances, noting name suppression was granted to the tenant following the previous hearing.

The landlord has not sought name suppression.
