Reasons
- The hearing was conducted by phone. Two phone calls to the tenant went to voice mail. The landlord attended the hearing, represented by Mr Hickey.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent?
- The landlord gave notice to end the tenancy. The tenant moved out before the end of the tenancy without given notice. The landlord asked for rent arrears up to 28 October 2025, being the date the tenant moved out.
- At that time the tenant also owed water rates. At a mediation in June, the tenant had agreed to pay the rates. This order incorporates the amounts ordered in the previous mediated order.
- The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy was $3,067.29 for rates and $2,780.40 for water rates.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must remove all rubbish. See section 40(1)(e) Residential Tenancies Act 1986.
- The landlord said that the tenant did not remove all rubbish and submitted and invoice for $868.69 for rubbish removal.
- Usually a landlord would provide photographs and/or entry and exit inspection reports showing the rubbish. However, the tenant did not attend the hearing to dispute the claim and so the landlord has established the claim on the balance of probabilities and the amount ordered is proved.
- The day before the hearing the landlord filed some further invoices. Because the tenant has not had notice of these matters, they could not be heard today. The landlord may file a further application in relation to those. It is recommended that entry and exit inspection reports are also filed.
- Because Central West Property Management Limited As Agent For Waimanuka Trust has wholly succeeded with the claim I must reimburse the filing fee.
