- The landlord attended the hearing which was held by video conference. At 8.12 am on the morning of the hearing (just over one hour before the scheduled start of the hearing) the Tribunal received the following email from the tenant: Dear Tenancy Tribunal Team, Thank you for your email regarding my upcoming hearing (Ref No: 5412568). I would like to advise that I currently do not have access to a phone, my hone is currently not working and the phone number previously provided is no longer active. Unfortunately, I also do not have a device available for a video hearing. I am willing to make payments of $50 per night towards my rent arrears and would appreciate it if this information could be noted on my file. As I am unable to be contacted by phone, please send any updates, hearing information, notices, and decisions regarding this matter to my email address: ----- @gmail.com. - I note the tenant has not requested an adjournment in this notice.
- On 19 March 2026, the Tribunal adjourned the hearing due to the tenant having health issues.
- This application is now six months old and it concerns simple claims.
- A party has the right to attend a hearing. See Residential Tenancies Act, 1986 (the “RTA) Section 93. Despite this right, I have heard the application by the landlord and issued this Order. I consider it in the interests of justice, and consistent with the RTA to dispose of this matter today in an expeditious fashion.
- I consider the tenant has given tacit approval to the hearing continuing in their absence.
- If the tenant is not satisfied with this Order or the Tribunal’s process, they may apply for a rehearing as set out in the information included with the Order below.
- The landlord has applied for rent arrears and compensation following the end of the tenancy.
How much is owed for rent?
- The tenancy ended on 23 October 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy is $2,174.00.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord was originally claiming $797.01 for cleaning costs and $1,762.42 for rubbish removal. At today’s hearing the landlord voluntarily reduced these claims to $104.26 for cleaning costs and $700.00 for rubbish removal.
- When I look at the start of tenancy photographs and the end of tenancy photographs and consider the condition the tenant left the premises in at the end of the tenancy, I am satisfied these are reasonable costs.
- The photographs show the tenant did leave some belongings and some rubbish inside and outside at the end of the tenancy, and these belongings and rubbish needed to be disposed of. I am also persuaded that some cleaning was necessary to return the premises to a reasonably clean and tidy state, but the amount of cleaning was not huge.
- The claims and amounts ordered are proved.
- This Order supersedes any Mediated Order for the same claims.
