The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy.
The tenancy ended on 21 February 2025. The landlord provided a water rates invoice which proves the amount owing for water at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The tenant did not return the keys.
The landlord provided photographs of the condition of the property at the end of the tenancy. There was a large volume of rubbish left at the property. No cleaning had been done. The landlord also provided evidence of the costs incurred. The amounts ordered for cleaning, rubbish removal and key replacement are proved.
Claims for carpet cleaning and carpet replacement (excesses) were withdrawn at the hearing. The withdrawals were appropriate as the landlord did not have sufficient evidence to prove those claims.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The following damage was caused during the tenancy: Multiple broken windows, wall and door damage. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
The landlord has proved its claims for the glass window replacement.
It has not proved its claim for $6,900 for wall and door painting and ancillary repairs. The landlord provided an in-going inspection check list, but not in-going photographs. The checklist confirms that the property was old and worn at the start of the tenancy. The landlord provided a quote for repairs but acknowledged that the work was completed by another contractor as part of a more extensive renovation. The contractor who did the work did not provide a breakdown for the repairs. Having regard to the photographs from the end of the tenancy, I award $2,500 for wall and door damage and removal of a partition wall in the garage.
As the landlord was the successful party I award reimbursement of the Tribunal filing fee.
