Reasons
- Only the landlord, represented by Ms Simpson, attended the hearing, which was conducted by videoconference. The tenants did not join the video meeting at the scheduled time, either by video or telephone. As the tenants have been notified, the hearing proceeded.
- This tenancy began on 8 September 2025 and ended on 23 November 2025, following an order of the Tribunal.
- The landlord originally applied for a disposal of goods order. As the tenants’ belongings have since been removed, this is no longer sought.
- The Tribunal has accepted the landlord’s amended application for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy. The bond has since been paid to the landlord following the Tribunal order of 20 November 2025, with the landlord confirming the bond was received on 13 January 2026.
How much is owed for rent?
- As earlier noted, the tenancy ended on 23 November 2025. The landlord provided updated rent records to the end of the tenancy, stating that no further payments had been received from the tenants since the tenancy ended. Did the tenants comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986 (the RTA).
- The landlord claims costs for rubbish removal, locksmith’s charges and lawnmowing/gardening. The landlord has produced photographic evidence showing the condition of the premises. This evidence establishes that the tenants did not remove all rubbish. An invoice for the rubbish removal costs of $885.50 was provided.
- The tenants only returned one set of keys (there were altogether two), so the landlord had to change the locks and keys, at a cost of $269.36, as shown in the invoice.
- The lawn needed mowing and some weeding was required. An invoice for the lawnmowing and gardening costs of $100.00 was produced.
