The applicant seeks: a) Rent arrears of $4,512.86 to 3 February 2026; b) $379.26 for key cutting for the front and back doors, changing access codes, and replacement of remotes for the common gate; c) Rubbish removal costs of $1,170.00; d) Cleaning costs of $632.50; and e) $3,200.00 for insurance excesses, being five separate insurance excesses incurred in relation to the replacement of the carpet.

The landlord has provided records showing the amounts owing up to 3 February 2026. I am satisfied that these records are accurate. The rent arrears are therefore awarded.

Section 40(1)(e)(iv) of the Residential Tenancies Act 1986 requires a tenant to return to the landlord all keys, security passcards, and any other devices provided by the landlord for the tenant's use. I am satisfied that the tenant failed to do so. Accordingly, the sum of $379.26 for key cutting, code changes, and replacement of the shared gate remote is awarded.

The landlord has provided photographic evidence taken at the end of the tenancy. The photographs show an extensive amount of rubbish strewn throughout the property, both inside and outside. The property was well short of the standard required by section 40(1)(e)(i) and (iii), which require a tenant to leave the premises in a reasonably clean and tidy condition and to remove all rubbish at the end of the tenancy.

I accept that the cleaning and rubbish removal costs were reasonably incurred as a result of the tenant's breach of these obligations. The claimed costs are therefore awarded.

Is the respondent liable for the insurance excesses relating to the carpet?

I have reviewed the photographs provided by the landlord, which show the carpet to be extensively stained and soiled. The applicant advised that the carpet contractor determined that the carpet could not be restored by cleaning and that replacement was required. As a result, the landlord incurred insurance excesses in relation to the replacement of the carpet.

I am satisfied that replacement of the carpet was required because of the tenant's breach of section 40(2)(a), which provides that a tenant must not intentionally or carelessly damage, or permit any other person to damage, the premises. I am satisfied that the damage to the carpet resulted from a breach of the tenant's obligations under section 40(2).

However, a landlord is required to record the applicable insurance excess in the tenancy agreement. The tenancy agreement records the excess as $500. I also note that, at the time the application was filed, the claim was advanced on the basis that the excess was $500. Accordingly, five insurance excesses of $500 each are awarded, rather than the $625 per excess now sought by the applicant. Filing fee and suppression

As the applicant has been successful in their application, the filing fee is awarded. I also grant the application for suppression.
