The landlord claimed for curtain replacement. The ingoing inspection report showed that the curtains and blinds were in bad condition at the beginning of the tenancy. The blinds and curtains were mouldy and sun damaged. They were not new curtains. At the end of the tenancy the curtains would have been six years older.
The tenant replaced the curtains because of their condition and because there was no thermal backing.
The Tribunal’s general approach is that landlords should not be put in a better position than if the damage had not occurred. Compensation is based on the remaining value of the item, not the full replacement cost.
The Tribunal’s depreciation guide gives curtains an estimated life expectancy of 8 years. Given the curtains were in bad condition at the start of the tenancy and there is no evidence of their age, I estimate that the depreciated value at the end of the tenancy is zero.
The landlord’s claim for replacement curtains is dismissed. Wall painting
The landlord claims for repainting walls in four rooms. The landlord produced a quote for $2,265.50. The tenant had painted the walls from a light colour to a brown colour. It is accepted that the landlord would want to repaint the walls due to the colour used.
The Tribunal must consider whether the quoted amount reflects the cost of restoring the walls to the condition they would have been in, considering fair wear and tear and depreciation.
