I am satisfied that the damage caused to the premises was intentional. The tenants had dogs, which caused a substantial amount of damage. The tenants allowed the damage to continue to the extent that extensive remedial work was necessary and the carpets had to be replaced at the end of the tenancy. The holes in the walls were clearly caused by intentional actions.

The amounts ordered are proved.

I have taken into account betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations, and should not be better or worse off. In calculating depreciation, I have taken into account the age and condition of the items at the start of the tenancy and their likely useful lifespan.

I have allowed a deduction of 20% on the repairs and carpet invoices to take account of betterment.

Loss of rent?

The landlord has claimed compensation for not being able to rent the property at the time the next tenant was scheduled. The Tribunal must assess whether there was a tenancy that was unable to proceed because of the repair work necessary to rectify the tenants’ damage and breaches. I am satisfied from the evidence that the landlord has proved the delay. The tenancy was to begin a week after the end of this tenancy. I have allowed two weeks from 16 January 2026 as compensation for loss of rent. Filing fee
