[The tenant/s] tenant/s] to pay Eves Realty Limited $1,266.00 from the bond, calculated as shown in table below. DescriptionLandlord Rent arrears (to 6 January 2026)$355.00 Cleaning$483.00 Rubbish removal$400.00 Filing fee reimbursement$28.00 Total award$1,266.00 Bond$1,266.00$1,134.00
The Bond Centre is to pay the bond of $2,400.00 (6016641-007) immediately apportioned as follows: Eves Realty Limited: $1,266.00 [The tenant/s] tenant/s]: $1,134.00

Reasons

Both parties attended the hearing.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The landlord claimed that the tenancy ended on 1 February and claimed rent to that date. The tenant disputed that, he said that he gave notice before Christmas, when he received notice of a rent and bond increase. He said he returned the keys to the landlord as soon as the property manager office opened in January 2026.
The property manager maintained that the tenant did not give notice. Initially, she said that she went to the property “the day before” the last date claimed for rent. That date would have been, Saturday 31 January 2026. She said that she realised that the tenant had moved out and accepted that the tenancy had ended so claimed rent to the next day.
That explanation does not match the timing of the property manager’s final inspection, on 12 January 2026 or the invoices for cleaning (17 January 2026) or rubbish removal (22 January 2026).
Given that discrepancy and inconsistency in the property manager’s evidence, I prefer the tenant’s evidence on this issue. That he gave notice in December 2025 and returned the keys when the office opened in January. I find that the tenancy ended on 6 January 2026.
Rent arrears owing to that date are $355.00. I have made an order accordingly.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
The landlord provided photographs from its final inspection report and invoices for costs incurred. The tenant disputes the claims. He says that he cleaning the property before he left and that some of the external “rubbish” had been at the premises when the tenancy started.
The photographs show that cleaning was required. Particularly the oven and toilet areas. The description of work done, and amount claimed in the invoice is reasonable. I award $483, as claimed.
However, the photographs do not support a claim of $850 for rubbish removal. Having regard to the photographs, and similar claims in the Tribunal, I award $400 for rubbish removal.
As the landlord was partially successful, I also award reimbursement of the Tribunal application fee.
