The landlord attended the hearing, represented by Ms Hall. There was no appearance for the tenant. The tenant had not attended the previous hearing. No attempt was made to call him at this hearing.

The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy as follows: a. Rent arrears $4,131.36 b. Bailiff $267.00 c. Filing fee for previous case $28.00 d. Cleaning $345.00 e. Rubbish $350.75 f. Lawns and gardens $141.00 g. Lock replacement $325.00

The onus is on the landlord to prove their claims. They must produce the evidence to establish the basis for the Tribunal to make the orders sought. The standard of proof is on the balance of probabilities.

How much is owed for rent?

The tenancy ended on 12 January 2026 by order of the Tribunal (TT5385962). Rent arrears to that date ($4,131.36) were ordered along with reimbursement of the filing fee for that case. The Tribunal ordered the bond be reimbursed to the tenant.

At this hearing, the landlord submitted a rent summary for rent owed to 9 February 2026. It showed the refund of the bond $2,540, with a balance owing of $4,131.36 up to 9 February. In fact, the rent owing up to 12 January had been ordered and so the amount claimed at this hearing included an amount already ordered.

The landlord did not know when the tenant moved out. Ms Hall said that when she attended with the bailiff on 9 February, the tenant had vacated. She understood that someone had driven by the property and the tenant appeared to be still living there at the end of January.

Ms Hall did not believe anyone had visited the premises because management had advised them not to do so. Ms Hall had started at the company on 12 January, the day the previous order had been made. She was unaware of any conversations with the tenant.

During the hearing, I gave Ms Hall the opportunity to produce any further evidence as to why a bailiff had been used, for example, copies of any emails or other correspondence with the tenant about moving out. As discussed at the hearing, sometimes the landlord and tenant have discussions about a moveout date a few days after the order is issued.

Given the tenant had moved out by 9 February, the landlord has not established that rent is owed to that date. There was also insufficient evidence before me to support a finding that on the balance of probabilities a bailiff was required for the eviction.

The claims for further rent and for the bailiff’s fee are dismissed.

The rent to 12 January and the filing fee for TT5385932 have already been ordered.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish and return all keys and security devices. See section 40(1)(e) Residential Tenancies Act 1986.

Ms Hall said that the tenant did not return the keys. An invoice for $325.00 was submitted for replacement locks. That amount is ordered.

In proving that the premises were not left reasonably clean and tidy or rubbish needed to be removed, the landlord usually provides photographs of the premises taken at the exit inspection. Entry inspection photographs provide a useful comparison. This is particularly useful in assessing the rubbish removal and garden maintenance.

Photos had not been filed with the application. During the hearing, an opportunity was provided for photos to be emailed through.

During the hearing, Ms Hall was able to email a copy of the entry inspection which shows an immaculately presented property.

No exit inspection report was located.

The only photos of the premises at the end of the tenancy are outside which show some weeds had take over some areas. The invoice of $141.00 is reasonable and that amount is ordered.

Ms Hall had conducted the exit inspection herself and so I asked her to describe the premises at the end of the tenancy. She said that items had been left inside and out. There were black sacks of items and a corner piece of a sofa set. The oven and toilet had not been cleaned and the carpets needed to be done.

The landlord claimed $350.75 for rubbish removal. The itemised account included tip fees.

In the absence of opposing evidence for the tenant, I have decided that it is more likely than not that the premises required cleaning and have allowed the $345.00 claimed.

The landlord is reminded that the tenant’s obligation is only to leave the premises reasonably clean and reasonably tidy, not to get the premises ready for the next tenant. The landlord may find that in some cases a failure to provide photographs means they are unsuccessful in establishing their claim.

Because The Rent Shop Limited As The Agent For Chris Templeton has substantially succeeded with the claim I have reimbursed the filing fee.
