The landlord attended the hearing. The tenant didn’t attend and couldn’t be reached by phone.

The landlord applied for rent arrears, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

During the hearing an additional claim was added for cleaning and rubbish removal costs. That claim had not been notified to the Tribunal or to the tenant and no evidence in support of the claim had been provided before the hearing.

I allowed the landlord to amend the application and consider that claim on the basis of direct evidence given by the property manager that the tenant had been notified about that claim, the basis for it and the invoice on which it is based. That being so, so in deciding not to attend, the tenant can be assumed to have known that claim would raised.

In future the landlord must ensure that any additional claims it wants considered are notified, with evidence in support, before the hearing.

How much is owed for rent and water rates?

The tenancy ended on 10 March 2026. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

During the hearing the landlord provided a copy of the exit inspection report. That report contains photographs and notes showing that significant cleaning of the premises was required to bring them to a reasonably clean and tidy condition. The tenant had left a large quantity of rubbish that needed to be removed.

The evident provided by the landlord in support of its compensation is entirely unsatisfactory. The contractor’s invoice simply says, “Rubbish removal x 3 trailers - $960.00 plus GST”

No dump receipts are provided showing the quantity of rubbish removed and the cost. No information is given about how long the contractors say it took them to do the work or the hourly rates charged, which makes it very difficult for the Tribunal to assess the reasonableness of the compensation claimed.

The property manager says that in fact, those contractors also undertook necessary cleaning work as well as removing the 3 trailer loads of rubbish. That is completely unclear from their invoice.

A noted, the evidence does show that a significant amount of cleaning work and rubbish removal was required due to breach of the tenant’s obligations. I accept that the landlord has suffered a loss in paying the contractor’s invoice and I will order compensation for that loss. To do otherwise risks unfairness to the owner.

The landlord neds to be aware that if it brings compensation claims late, without prior notice to the tenant and unsupported by evidence that enables the Tribunal to more effectively assess the reasonableness of the claims, there is a real risk that those claims will be declined.

The cost of resetting the alarm is not proved to have been caused by any breach by the tenant. That claim is declined.

Because Baath Rentals Limited as Agent For Ipshita Arora & Gagan Deep Singh has substantially succeeded with the claim I must reimburse the filing fee.
