The tenancy ended on 22 February 2026. The landlord provided rent records which prove the amount of rent owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit 1 .

The tenant did not return the keys. The tenant reprogrammed the master code for the electronic keypad/lock system. When asked for the code so the landlord could re-programme it at the end of the tenancy, the tenant did not respond. The entire electronic locking unit had to be replaced.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission 2 .
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent) 3 .
The following damage was caused during the tenancy: •There were oil stains on the front driveway that had to be removed •The kitchen bench was damaged by a burn mark •The induction cooktop was damaged •The fridge was damaged •The dishwasher drawer was damaged •Carpet in 2 rooms was so badly stained it had to be replaced •A bedroom door was damaged •The vanity unit was damaged.
The landlord’s insurer accepted claims for the damage noted above but applied an excess of $400.00 to each claim. The tenant’s liability is limited to the combined amount of the insurance excesses.
Two roller blinds were damaged and had to be replaced. The cost of each blind was below the amount of the insurance excess. The tenant is liable for the replacement cost of the blinds.
Walls throughout the premises were damaged and had to be repaired and re- painted. The landlord’s insurance did not extend to that damage (considered as multiple claims). The tenant is liable for the repair cost. 2 See sections 40(2)(a), 41 and 49B RTA 3 See section 49B(3)(a) RTA
The amounts ordered are proved by invoices, pre and post tenancy inspection reports, and photos and by the evidence Ms Chappell gave at the hearing,

As the application is successful, I have reimbursed the filing fee the landlord paid.
