I am satisfied that it is appropriate to exercise the Tribunal’s discretion to dispense with the requirement for service and to proceed with the hearing having regard to the following considerations: a. There is no reason to believe that Ms Berry did not receive notice of the hearing by email. b. Ms Berry has chosen not to engage with Century 21 since the end of the tenancy. c. The landlord has incurred significant costs and inconvenience and it would be unjust to delay proceedings. Rent and water

I will not award mileage in addition to the labour cost. All parties must mitigate their loss. Landlords can do the work themselves, but the tenant should not pay more if the work could have been done at less cost by a local contractor. Repairs

Tenants are liable for damage that they carelessly or intentionally cause, or that is carelessly or intentionally caused by anyone who is at the premises with their consent 5 .

The landlord’s evidence establishes damage to the premises during the tenancy including: a. Damage to the ranchslider door. b. Damage to the garage door locking mechanism. c. Multiple holes in walls. d. Heavily stained carpet throughout the house.

The cost of repairs to the ranchslider door and the garage locking mechanism is proven.

Most of the holes seem to have been caused by door handles. The doors have door stoppers. The damage is beyond fair wear. The cost of repairs is proven.

The carpet was new at the beginning of the tenancy. Ms Cocurullo’s photographs show that the carpet was very badly stained at the end of the tenancy. The claim for replacement of the carpet is fair and reasonable.

The owners made an insurance claim for carpet replacement. The insurers accepted a claim, but applied a policy excess ($550) per room. The total cost of excesses was $2,200.00.

The landlord’s claim is $1,980.00, which is the equivalent of four weeks’ rent. This is a tenant’s maximum liability for careless damage 6 , but it is a maximum that applies per incidence of damage.
