The Bond Centre is to pay the bond of $1,849.56 (6148212-003) to Buy West Property Management Limited immediately. The Bond Centre is to pay the bond of $390.44 (6148212-003) to Vivekkumar P Dihora immediately.

Reasons

The landlord attended the hearing. The tenant did not attend the hearing.
The landlord applied two months after the tenancy ended. Section 91A(2) sets out the law in relation to applications filed two months after the end of the tenancy. Section 91A(2) states that the application must be served on the tenant by posting it to a contact address that the tenant has supplied to the landlord in writing within the 2 months before the application.
The landlord received an email from the tenant on 11 August 2023 asking about refund of the bond. The landlord responded with claims to the bond following the end of the tenancy. The tenant did not respond to these claims.
The landlord filed the application on 11 October 2023. The tenant had emailed the landlord two months prior to the filing of the application by using the email address that is his address for service. Given this I am satisfied that the tenant has notice of this application and hearing.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
The amounts ordered are proved.
Because Buy West Property Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
