Rayella Carolyn Greening must pay the landlord $5,158.17 immediately, calculated as shown in table below.
The Bond Centre is to pay the bond of $1,800.00 ([Bond number suppressed]) to the landlord immediately.
The landlord must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.
The landlord may dispose of the other goods left at the premises by the tenant as the landlord sees fit.
The tenant must repay the balance of the personal loans given to her by the landlord on 3rd and 24th August 2023.

Reasons

The landlord attended the hearing. The tenant did not.
I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy ended on 8 January 2024. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
The oven needs to be cleaned as the oven is a chattel the house removal company now owns and requires to be in a reasonably clean and tidy state.
The amounts ordered are proved. Loans made to the tenant.
The landlord loaned the tenant $400.00 to purchase a car on 3 August 2023. $300.00 of this loan has been repaid at $30.00 per week for a period of 10 weeks. The balance of $100.00 of the loan is still outstanding.
The landlord loaned the tenant $480.00 to purchase things for her son’s birthday. None of this loan has been repaid and remains outstanding.
The loan arrears of $480.00 is to be paid by the tenant immediately. Disposal of goods of no value
The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.
The landlord had the tenant’s agreement that she would collect her personal property before 14 January 2024. She had still not collected her belongings as at today’s date. The removal company needs to relocate the house it has paid for, and now owns. Therefore, the landlord cannot grant the tenant any further time to remove her property.
I have seen proof that the personal property consists of the following items of no resale value, many of which are broken, unclean, in a bad state of repair and/or not functioning: a. 3 beds and mattresses; b. Sofa c. Fridge that does not work; d. Toaster; e. Beside table; f. Dining table and chairs; g. Cracked gas heater; h. Coffee table; i. Clothing, bedding and various other household items such as food and kitchenware.
It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore, the landlord may dispose of the goods as it sees fit. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986. Reimbursement of filing fee
Because the applicant has wholly succeeded with the claim I must reimburse the filing fee.
