Reasons

Both parties attended the hearing.
The parties had attended mediation on 25 March 2024 where agreement was reached in respect of rent arrears, water rates and rubbish removal. Those claims are included in this order as per the agreement.
The issue that was not resolved and needed to be considered by the Tribunal was the pest control costs amounting to $969.45.
Following the mediation the bond of $3,160.00 was released to the tenants with $1,214.19 remaining with the Bond Centre pending resolution of the issue before the Tribunal.
The rodent issue came to the attention of the parties in December 2023 when the tenants reported a problem with the dishwasher. It was discovered that a pipe leading to the dishwasher had been eaten by rats. The landlord suggested that the tenants employ a professional pest control company.
The tenants did not employ a professional pest control company and instead purchased a rat trap and caught one rat before the tenancy ended.
After the tenancy ended the landlord discovered that the pest problem was still present and employed a professional pest control company. That company needed to attend on three occasions to address the issue.
The pest control company provided a report which found that there were several matters contributing to the rat problem. These included the overgrown and untidy garden, the accumulated rubbish and debris, access points inside the home and environmental factors.
The landlord considers that the tenant is at fault because there was some old furniture that was not removed by the tenant and the tenant is responsible for keeping the outside area reasonably clean. The tenant thinks that the landlord is at fault because of the two access points (under the kitchen cabinet and hallway cupboard) for the rats. The tenant also says that the hedge is overgrown and that is a maintenance issue for the landlord.
After considering the evidence I have reached the view that the costs of pest control in this situation should be shared between the parties. The landlord is at fault due to some maintenance issues in relation to the hedge and the holes allowing the rats access into the premises and the tenant is at fault for not removing rubbish furniture that may have attracted the rats.
I have therefore shared the cost of the pest control and awarded half to the landlord. The bond money is divided accordingly.
As the landlord has been substantially successful with their application, I have reimbursed the filing fee.
