The landlord attended the hearing. The tenants did not attend.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy ended on 22 December 2023 by order of the Tribunal TT 4723992. Despite the termination order the tenants did not leave as they had nowhere else to go. As a result, the landlord had to have them evicted by bailiff on the 22 February 2024.
A tenant remains liable for rent whilst they are in possession of the property (See s60 RTA) and therefore, I make an order for rent from 23 December 2023 to 22 February 2024. The landlord provided rent records which prove the amount owing.
The tenant agreed to pay for water in the tenancy agreement. The landlord is entitled to paid for the water bills of December - February and those amounts are awarded.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
The tenant did not return the keys.
The amounts ordered are proved.
On 19 December 2023 the Tribunal made an order relating to this tenancy, for rent arrears to 19 December, rent to 22 December and the filing fee The previous order is incorporated into this order for enforcement purposes.
I record that I am satisfied that McDonald Property Management Limited is the landlord’s agent. I record this as the property manager advised me that the previous property manager Ms Param Kaur of Manukau City Property Management Limited, had allegedly told the tenants not to pay McDonald Property Management. I have seen the letters sent by McDonald Property Management to the tenants confirming that they are the property managers. The property managers also tell me that when they went to the property the tenants seemed genuinely confused about who the property managers were. The tenants told the property manager that they had continued to pay Manukau City Property Management but have not provided any evidence to show this. McDonald Property Management have asked Ms Kaur if she has received rent for this property, but she says she has not. If the tenants have evidence that shows that rent has been paid for this property, then they should bring that to the Tribunal and to McDonald Property Management’s attention.
As McDonald Property Management Limited has been successful in their claim I award them the filing fee.
