Reasons

The landlord’s representative attended the video hearing. The tenant did not attend, and her phone was switched to voicemail when I rang. She has been sent notice of the hearing date and time by post and email, so I continued in her absence.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The tenancy ended on 18 April 2024. The landlord provided rent records and water rates invoices which prove the amounts owing at the end of the tenancy and these are awarded.
A tenant has obligations to leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. There were several stains on the carpet in various rooms. I award the amounts claimed as these are reasonable for the work done.
There were additional costs for:- a. A plumber attending to resolve a toilet blockage, and b. Repair of the carpet on two stairs where it appears a pet may have clawed the carpet over time.
The evidence is that the plumbing problem was caused by excessive toilet paper. The blockage happened during the tenancy and is the tenant’s responsibility, so the claim is awarded.
The damage to the carpet is more than normal wear and tear and the tenant is therefore liable. The insurance excess is $400.00 which is the limit of a claim for careless damage. In this case, I award the full cost of the repairs. I consider that the tenant must have allowed the pet/s to continue to claw or scratch at this area of carpet over several occasions. This is intentional damage. See Guo v Korck [2019] NZHC 1541.
All invoices were provided.
The landlord has wholly succeeded with the claim. I award the filing fee and suppress its name, as sought.
