In the event the goods are not collected by the tenant by 27 December 2024, the landlord may dispose of the goods left at the premises by the tenant as the landlord sees fit.
The landlord may file further proceedings for additional storage costs and for costs to dispose the tenant’s goods left behind after 27 December 2024.

The landlord has applied for rent arrears, compensation and an order for the removal/disposal of goods, following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 11 September 2024. The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
The tenant did not return the keys.
The landlord had to replace light bulbs.
The amounts ordered above are proved.
The landlord has also applied for the disposal of goods the tenant left at the premises at the end of the tenancy. The tenant’s belongings have since been moved into a storage facility at the tenant’s request which costs are accruing on a weekly basis.
The landlord is unable to agree with the tenant on a period for the tenant to collect the goods.
The tenant could not commit to a date to retrieve her goods and belongings from the storage facility. The tenant has since relocated to Hawkes Bay.
It is not practicable for the landlord to the return the goods to the tenant in the circumstances. The value of the goods is below the cost of storing, transporting and selling them.
I consider it appropriate to set a 4 week date for the tenant to retrieve her belongings. Storage costs continues to accrue on a weekly basis at $100 each week.
I allow the tenant until 27 December 2024 to retrieve her goods and belongings from the Secure Storage facility. The landlord is to provide the exact address to the tenant.
In the event the goods are not collected by the tenant by 27 December 2024, the landlord may dispose of the goods left at the premises by the tenant as the landlord sees fit. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
