Both parties attended the hearing which was held by phone. The landlord was represented by Mr Liu.
The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

This was a long standing tenancy which began on 9 March 2021 and ended on 17 February 2025. The tenant got into financial difficulty at the end of her tenancy. The bond had been released to the landlord to cover most of the rent arrears. There is an outstanding balance of $1580.43 which the tenant agrees is owing.
The order for rent arrears is made by consent.
The landlord seeks $357.46 for water arrears and produced invoices setting out the amounts claimed. The tenant agreed the amount owing.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (“RTA”).
The landlord said that the tenant did not leave the property reasonably clean and tidy and did not remove all rubbish.
The landlord produced an invoice from Clean and Fix for cleaning as follows:
The tenant accepted that she left rubbish (furniture and other items) behind. She said that she did not have the ability to remove all of her belongings and so had to leave things behind. She accepted that the landlord had incurred costs removing the items.
The claim for rubbish removal ($253.00 including GST) is made by consent.
The tenant disputed the amount claimed for cleaning. She said that she cleared out the fridge and cleaned the property well although she accepted that there were some carpet stains and that she should be liable for cleaning the carpet. She noted that the carpets were old and were old when she moved in. She did not consider that she should be liable for any additional cleaning.
Tenants only need to leave a property reasonably clean and tidy. They do not need to leave it spotless and ready for a new tenant to move into. It is to be expected that a landlord will need to do additional cleaning between tenancies, particularly after a tenancy of this duration.
The landlord sent through photos during the hearing but these photos are of items left behind and of the carpet stains and only very minor matters. I am not satisfied that, with the exception of the carpet stains, the tenant has not left the property reasonably clean and tidy overall.
As there is no breakdown in the invoice for carpet cleaning I have had to estimate the portion of the invoice that relates to carpet cleaning. I consider the amount of $100.00 to be reasonable based on the photos. Filing fee and name suppression
The landlord has been the substantially successful party and so I have reimbursed the filing fee.
The landlord did not seek an order for name suppression.
At the hearing the tenant explained that she wanted to resolve matters at mediation but missed the mediator’s call as she was at work, and although she called straight back the mediation could not be convened.
The tenant appeared today and agreed to all matters except the general cleaning, which has not been proved.
I consider that it is appropriate for me to exercise my discretion under section 95A RTA to make an order suppressing the tenant’s name and identifying details, as these orders are made more or less by consent and the landlord’s claim could have been resolved at mediation.
