At the end of the tenancy, the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord provided photographs from the start and end of the tenancy that satisfy me that the tenant did not leave the premises reasonably clean and tidy and did not remove all belongings and rubbish.

The tenant did not return the keys at the end of the tenancy. I award the claim for the invoiced cost to rekey the house.

I reduce the amount claimed for cleaning by 25% as some of the cleaning work to be done is beyond what is expected of a tenant (eg; interior and exterior window and glass door cleaning (degreasing and polishing)). I award $330.00.

I have made an order authorising the landlord to dispose of a trampoline, washing machine, two mattresses and any other goods as the landlord sees fit. The landlord contacted the tenant to collect these but has received no response.

It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.

I award the quote for removal of the goods and rubbish, and mowing the lawns, as this is reasonable for the work to be done.

I also award compensation for the cost of replacing locks and keys earlier in the tenancy after the tenant lost the keys. The landlord has not yet been reimbursed by the tenant.

I award the cost of removing an external security camera installed by the tenant.

The landlord is entitled to the filing fee as its claims are successful. Anti-social behaviour

The landlord has included in their application an allegation and evidence that the tenant engaged in anti-social behaviour near the end of the tenancy.

Specifically, that the tenant sent several texts and emails to the landlord’s agent/s containing personal and professional insults and swearing.

The Residential Tenancies Act provides that a landlord may give a tenant written notice of an incident of alleged anti-social behaviour and, if there are three such instances and notices within a 90-day period, may apply to the Tribunal to terminate a tenancy. See section 55A RTA.

Antisocial behaviour includes harassment or any act (whether intentional or not) that reasonably causes alarm, distress or nuisance that is more than minor.

Harassment means "to trouble, worry or distress" or "to wear out, tire, or exhaust" and "indicates a particular pattern of behaviour directed towards another person". MacDonald v Dodds, CIV-2009-019-001524, DC Hamilton, 26 February 2010.

The landlord did not issue notices to the tenant because the tenancy was nearing its end.

I agree that the tenant has engaged in anti-social behaviour by sending these texts and emails to the landlord’s agent. They would have reasonably caused alarm and distress to most people.

I make no other finding or award because the legislation does not provide for it.

It is an unlawful act for a landlord to harass a tenant, 1 or for a tenant to harass a neighbour or other tenant, 2 and up to $3,000.00 can be awarded in exemplary damages. Residential tenancies legislation does not similarly protect a landlord, agent, or owner, from being harassed by a tenant as they go about their work. 1 See section 38(3) and Schedule 1A RTA. 2 Section 40(3A)(d) and Schedule 1A RTA.
